Store policies

The InWhite Store Rules, which can be found at https://inwhiteuniforms.es, defines the rules for placing orders and selling goods through the InWhite online store, as well as by phone and e-mail.

§ 1. Introductory provisions

1.1. The Client's ordering of goods through the online store https://inwhiteuniforms.es (hereinafter referred to as the "SHOP") constitutes the Client's consent to the provisions of these Rules and the Client's obligation to comply with its rules. The Client who places an order for goods by phone or e-mail, before concluding the contract, receives information about the binding Rules, and is also warned of the need to familiarize himself with its content and accept its rules.

1.2. Sales through the online store https://inwhiteuniforms.es, by phone or e-mail are carried out by InWhite, the store is located at: C. de la Fuente del Berro, 11, Salamanca, 28009 Madrid, Spain.

1.3. The SHOP, operating at https://inwhiteuniforms.es, is used to make purchases of goods included in the InWhite offer without the simultaneous physical presence of the parties, exclusively using one or more means of remote communication until the end of the contract, inclusive.

1.4. Only persons with full legal capacity may place orders and make purchases in the STORE.

1.5. The store's offer is valid on the territory of Spain.

1.6. The main condition for the fulfillment of each order placed by the Client is the correct completion of the various stages of ordering, such as: selecting a product, providing contact information, choosing a payment and delivery method, and confirming the order.

1.7. All prices are quoted in euros and include VAT. The price quoted for each product is binding at the time of ordering by the customer. The price does not include shipping costs.

1.8. If the Consumer is obliged to pay more than the agreed price, which will include the elements specified in clause 1.7. above, InWhite will notify the Consumer of this fact. Additional costs will be charged to the Consumer only after obtaining the Consumer's explicit consent.

1.9. All files, texts, photographs or graphic elements on the website https://inwhiteuniforms.es (hereinafter: “Material”) are protected by copyright and may not be used by the Customer in any way or form without the prior consent of the store. In particular, the customer is not entitled to:

  • copying or duplicating the Material in any form or by any means,
  • creation of derivative or similar works based on the Material,
  • distribution and/or dissemination of the Material,
  • public presentation of the Material,
  • use the Material in business activities, including for the provision of any services or for the delivery of product.

§ 2. Checkout and order

2.1. An order in the STORE can be placed through the STORE website (this form requires prior registration of the Customer on the STORE website), by phone and by e-mail. The Customer has the right to cancel the registration in the STORE at any time.

2.2. After placing an order, InWhite will notify the client of its acceptance to the email address, phone or fax number provided by the client.

2.3. The agreement between the Customer and InWhite is currently in place:

  • confirmation of the order InWhite – in case of placing orders through the website of the STORE;
  • The Customer shall send to the e-mail address of the SHOP a statement of consent to the conclusion of the agreement in accordance with the order confirmed by InWhite in case of placing orders by phone, e-mail or fax.

2.4. Orders can be placed 24 hours a day all year round. Orders placed on weekdays after 15:00, on Saturdays, Sundays and holidays are processed on the next business day.

2.5. InWhite reserves the right that the information on stock levels may differ from reality.

§ 3. Implementation of the contract

3.1. Orders are fulfilled by the InWhite Sales Office at: C. de la Fuente del Berro, 11, Salamanca, 28009 Madrid, Spain.

3.2. The customer of the InWhite online store receives information by e-mail after further changes in the order status. The next steps of the order:

  • waiting for confirmation
  • confirmed (transferred to the warehouse to complete the order)
  • completed (execution of the trade document)

3.3. InWhite delivers the ordered goods to the Customer via the Correos transportation company in accordance with the data contained in the confirmed order. The Customer can also pick up his/her order at one of InWhite's stationary stores without incurring delivery costs.

3.4. If InWhite needs to obtain additional information to fulfill the order, InWhite reserves the right to contact the Customer by phone or e-mail at the number provided during the ordering process. This number can also be used by the courier to contact the customer in case of difficulties with the delivery of the parcel with the product.

3.5. In the absence of all the ordered goods, partial fulfillment of the order is possible at the request or with the consent of the customer. In this case, the cost of delivery is calculated for each shipment in accordance with clause 6 of these Regulations. In the event of such a situation, InWhite may contact the customer by phone or e-mail to offer a replacement for the missing product.

3.6. In the event of a discrepancy between the delivered goods and the order placed, the Buyer shall immediately notify InWhite thereof, i.e. within 3 calendar days from the date of receipt of the shipment with the order.

3.7. The customer has the right to change the order as long as the goods have not yet been shipped by InWhite. For this purpose, contact the InWhite sales office by phone or e-mail and provide the data to be changed. After they are confirmed, the customer can change the order.

The customer may not change an order accepted for fulfillment in accordance with the customer's specifications or designed to meet his or her individual needs. Once the goods have been shipped to InWhite, the customer cannot cancel the order.

Non-standard goods or goods made at the individual request of the customer, i.e. with an embroidered logo or inscription, with changed sizes or other changes made by special order, as well as in a color that exceeds the catalog standards, are not subject to return and exchange.

§ 4. Order fulfillment time

4.1. The Customer's order will be confirmed by InWhite immediately, but no later than within 7 days from the date of order placement. In case of impossibility to fulfill the order, instead of confirmation, InWhite will notify the Customer of the impossibility of its fulfillment no later than within 7 days from the date of placing the order.

4.2. The order fulfillment period, which is available in the online store, is 3 business days. The delivery time of the ordered goods depends on the chosen delivery method and is up to 5 days from the date of dispatch of the goods by InWhite, unless the parties agree on a different date.

The products covered by the order will be shipped by InWhite within 4 weeks from the date of confirmation of the order by InWhite, unless the parties agree on a different date.

The order processing time for goods that are not available in the online store, i.e., an order transferred for sewing after the Customer has placed an order, is up to 4 weeks from the date of order confirmation.

4.3. The order is sent after filling all the ordered products.

4.4. The order can be realized in parts only at the request of the customer.

4.5. InWhite reserves the right to refuse to fulfill an order for reasons beyond its control, and shall immediately notify the customer thereof.

§ 5. Payment methods

5.1. InWhite accepts the following forms of payment for the ordered product:

§ 6. Shipping costs

6.1. The cost of delivery depends on the chosen delivery method. The customer is informed about the shipping cost after adding the item to the cart. The cost of shipping outside of Spain depends on the country of destination, as well as the size and weight of the shipment.

§ 7. Documents for sale

7.1. Each purchased product will be accompanied by a proof of purchase in accordance with the provisions of Polish law in the form of a cash receipt or VAT invoice.

7.2. If the Buyer bears the costs of delivery of the goods, the delivery costs shall be indicated in the delivery document.

7.3. If the customer has made a prepayment and the order has not yet been fulfilled, InWhite is obliged to issue an invoice confirming receipt of the prepayment within 7 days.

7.4. InWhite does not issue duplicate receipts from the cash register.

7.5. When the product is delivered to the Buyer, the Buyer is obliged to check whether a receipt or VAT invoice is attached to the product. If the shipment is not accompanied by a document confirming the purchase of the goods, the Buyer is obliged to immediately contact the InWhite sales office.

7.6. In order to receive a VAT invoice, you must request one by filling out the contact form during the ordering process. A subsequent invoice is only possible until the order is shipped by InWhite. The customer must immediately notify InWhite of their readiness to issue an invoice by contacting the InWhite sales office by phone or email.

7.7. In the event of a return or replacement of the purchased goods, a correction to this document is made in the sales invoice.

§ 8. Warranty

8.1. InWhite provides a 365-day quality guarantee for the goods sold. The warranty period starts from the date of delivery of the goods to the buyer. After the expiration of the period specified in this section, the warranty rights become void.

8.2. InWhite, as a guarantor, is only liable for a physical defect in the goods if the defect causes the goods to be unsuitable for ordinary, normal use and if the defect arose from a cause inherent in the goods to the risk of accidental loss or damage to the goods handed over to the customer.

8.3. In the event of a defect during the warranty period, which is notified to InWhite, InWhite undertakes to repair the damage by repairing the goods under the warranty. After two unsuccessful repairs of the same defect in the goods, the Buyer has the right to demand the replacement of the goods with defect-free products.

8.4. The legal regulation within the scope of the warranty provided by InWhite is determined only by the provisions of clause 8 and clause 9 of these Rules.

8.5. In connection with the provision of the quality guarantee, InWhite excludes its liability under the guarantee for defects in the goods. This does not apply to the sale of goods to the Consumer specified in clause 10.1. Regulations.

§ 9. Warranty claim procedure

9.1. The Customer shall report the detected defect of the goods in the manner prescribed by clause 2.6. of these Rules.

9.2. A complaint filed by telephone shall be subject to written confirmation by the Customer.

9.3. A condition for consideration of a complaint is:

  • submission by the Client of a confirmation of purchase of the product, and
  • Sending the purchased goods to InWhite, and the goods are sent at the client's expense. Parcels sent to InWhite by cash on delivery are not accepted by InWhite.

9.4. InWhite shall process claims promptly, but no later than 14 business days from the date of receipt of the advertised product together with proof of purchase. This deadline may be extended only for reasons beyond the control of InWhite, of which InWhite will immediately notify the Client.

9.5. Upon receipt of the parcel with the goods, the customer is obliged to check its contents. The customer shall report any visible damage to the goods (for example, the condition of tapes, seals) to the person delivering the product (courier) and the protocol signed by the customer and the person delivering the product.

9.6. Mechanical damage to the shipment caused during transportation will be considered only on the basis of a written damage/inconsistency report drawn up upon receipt of the goods, in the presence of the courier and with its confirmation. In case of damage to the shipment, please refuse to accept it and draw up a corresponding damage report. In accordance with the transport legislation, the recipient of the parcel, who noticed its damage after the courier's departure, can report it by phone to the courier company.

9.7. Failure of the Client to fulfill the obligations listed in clause 9 may be grounds for non-acceptance of the Client's complaint or its negative consideration by InWhite.

9.7.1. If the complaint is upheld, InWhite will either repair or replace the product or refund the price of the product complained of, less any costs incurred by InWhite.

§ 10. Selling to the consumer

10.1. Consumer is an individual who purchases goods for purposes not directly related to professional or business activities.

10.2. InWhite is liable to the Consumer under the warranty for physical and legal defects of the product.

10.3. A physical defect of the goods consists in the non-compliance of the goods sold with the contract, so if the goods do not have the properties that they should have, as follows from the circumstances or purpose, they do not have the properties that InWhite has provided to the Customer, are not suitable for the purposes for which the Consumer has informed InWhite when concluding the contract, and InWhite has not raised any objections to its intended use, the Product has been delivered to the Consumer in an incomplete condition.

10.4. A legal defect in a product occurs when the product is the property of a third party or is encumbered by a third party's right, when restrictions on use or regulation result from a decision or order of a competent authority.

10.5. In the case of the Consumer, public assurances by the manufacturer or an entity that places the product on the market as part of its business activities or that represents itself as the manufacturer are equivalent to the assurances of InWhite. However, InWhite shall not be liable if he or she did not know these representations or could not have known them, or if these representations could not have influenced the consumer's decision to enter into the purchase agreement, or if the content of these representations was corrected before the conclusion of the purchase agreement.

10.6. InWhite shall be liable under the warranty if a physical defect is detected within two years from the date of delivery of the goods to the Consumer. If a physical defect is detected within one year from the date of delivery of the goods, it is considered that the defect or its cause existed at the time of delivery of the products.

10.7. InWhite is responsible for the warranty for physical defects of the goods that existed at the time of the transfer of danger to the Consumer or arose due to a cause inherent in the products sold at the same time.

10.8. If the goods are defective, the Consumer may file a declaration of price reduction or withdrawal from the contract if InWhite does not immediately replace the defective goods with defect-free goods or eliminate the defect. This limitation does not apply if the goods have already been replaced or repaired by InWhite or InWhite has failed to fulfill its obligation to replace the goods with defect-free products or to repair the defect.

10.9. If the product has a defect, the Consumer may also demand the replacement of the product with a defect-free product or the elimination of the defect.

10.10. The Consumer may, instead of remedying the defect offered by InWhite, demand the replacement of the goods with defect-free goods or, instead of replacing the goods, demand the removal of the defect, if this is not possible, bring the goods into compliance with the contract in a manner chosen by the Consumer or require excessive costs in connection with the payment method offered by InWhite.

10.11. The consumer cannot withdraw from the contract if the defect is not significant.

10.12.InWhite recommends using best practices when using the products offered, including washing clothes according to the instructions on the labels, washing the product first (i.e. without attaching other clothes), washing colored and white clothes separately.

10.13. InWhite undertakes to respond to the complaint within 14 days from the date of its receipt.

10.14. If the complaint is substantiated, InWhite undertakes to replace the defective product with a product without defects or to eliminate the defect within 14 days from the date of notification of the complaint by the Consumer.

10.15. In case of actual withdrawal from the contract, InWhite undertakes to refund the payment within 14 days from the date of receipt of the withdrawal, provided that the payment is not refunded until the goods are returned or until the Consumer provides proof of their return.

10.16. A claim for the elimination of a defect or the replacement of goods with goods without defects expires one year after the date of discovery of the defect, but the limitation period may not expire before the expiration of two years.

10.17. The Consumer exercising the rights under the warranty at the expense of InWhite will deliver the defective goods to the Seller at the address specified in the clause. 2.6 Provisions.

§ 11. The right of the consumer to withdraw from the contract

11.1. The consumer may withdraw from the contract of sale of goods purchased in the STORE without giving any reason by submitting a written application within 14 days from the date of delivery of the goods (i.e. from the date of receipt of the goods by the consumer). To meet this deadline, it is sufficient to send the application before its expiration.

11.2. The right to withdraw from the contract does not apply if the ordered goods are made to the consumer's specifications or serve to meet his or her individual needs.

11.3. The Consumer may withdraw from the Agreement by submitting an application for withdrawal from the InWhite Agreement.

11.4. The application for withdrawal from the agreement should be sent to the address specified in clause 2.6. of the Regulations with the note «Exchange and Complaints Department».

11.5. The consumer returns the InWhite product within 14 days from the date of withdrawal from the contract. To meet the deadline, it is enough to return the product before the expiration date.

11.6. The goods shall be returned to the InWhite address specified in the clause. 2.6 Regulations.

11.7. Within 14 days from the date of receipt of the withdrawal request, InWhite will refund all payments made by the Consumer, but the payment will not be refunded until the products are returned or the Consumer provides proof of their return.

11.8. InWhite will refund the payment using the same payment method used by the Consumer.

11.9. The Consumer shall bear the cost of returning the goods to the Seller. If the goods are replaced with another product and the previous one corresponded to the order, the shipment shall be made at the expense of the customer.

11.10. In order for an exchange or return to be accepted, the item must be intact; that is, unworn, complete with tags, and odorless.

11.11. There is no possibility of personal exchange/return in the salon.

11.12. In case of an exchange, the shipping cost and/or price difference will be added as payment upon delivery.

§ 12. Privacy policy

The provisions of the privacy policy are specified in the document "Privacy Policy" located at Privacy policy

§ 13. Final provisions

13.1. These Regulations shall enter into force on the date of their publication on the InWhite website.

13.2. Consolidation, protection, and disclosure of the essential provisions of the contract is carried out by printing and sending to the Customer, along with the document confirming the purchase of the products and instructions on the possibility of withdrawal from the contract.

13.3. InWhite reserves the right to change the provisions of the Rules at any time. Any changes to the Regulations come into force from the moment they are announced on the InWhite website.

13.4. In matters not covered by the Rules, the provisions of Spanish law shall apply.

13.5. Any disputes that may arise between the Customer and InWhite will be resolved by a court competent for InWhite. This does not apply to the sale of goods to the Consumer referred to in clause 10.1. Regulations.

13.6.The Rules do not exclude or limit any rights of the Customer, who is a Consumer, to which he/she is entitled in accordance with mandatory provisions of the law. In the event of a conflict between the provisions of the Regulations and mandatory provisions of the legislation granting rights to Consumers, these provisions shall prevail.
